Employment law is a broad and increasingly complex and interesting area of practice impacting every aspect of the employer-employee relationship and the relationships between employers and third parties such as independent contractors. I have developed a rich experience in employment law and its application which not only requires an understanding of its historical development but also diligence in staying abreast of the ever expanding statutes, administrative regulations and court decisional law. I counsel and advise employees and employers throughout California and in other states on minimizing conflict and avoiding becoming a party to adversary proceedings. To this end, I provide training, periodic e-mail and/or newsletter updates and of course, specific legal advice as matters arise – and better yet, before they arise.
My services include:
-Directly handling the representation of employees and employers in legal proceedings before judges, juries, arbitrators and mediators, in state and federal court and in the various agencies including the DFEH, DLSE and EDD and Federal EEOC, and other administrative agencies.
-Counseling employers and employees regarding the full spectrum of employer-employee relations, including but not limited to wage and hour issues, discrimination and harassment claims and defense, hiring, terminations, resignations, whistleblower claims, mental and physical disability issues, Fair Labor Standards Act claims, and workplace investigations.
-Counseling employers and employees regarding compliance with innumerable employment related laws and regulations including but not limited to California’s Fair Employment and Housing Act, the 1964 Civil Rights Act, the Americans with Disabilities Act, the Age Discrimination in Employment Act, the Family and Medical Leave Act, the California Family Rights Act, the Fair Labor Standards Act, the California Occupational Safety and Health Act and the new California Paid Sick Leave act and various other laws governing leaves of absence and workplace rights, security and privacy.
–Counseling employers, employees and independent contractors regarding negotiation, review and execution of all aspects of employment, compensation, consulting and commission agreements, including incentive compensation agreements, stock options, restrictive covenants, trade secrets, and confidential and proprietary information identification and protection.
-Counseling on and preparation of employee handbooks and other employment policies and procedures.
